Terms of Service

These Terms of Service ("Terms") govern your use of LakaPlay's website, games, and related services (collectively, the "Services") provided by 3NM LIMITED ("we", "us", or "our"). By accessing or using the Services, you (as a parent or legal guardian of a child user, or an adult user) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Eligibility

The Services are primarily intended for children under the age of 14 ("Child Users"). By allowing a Child User to use the Services, you represent and warrant that you are the parent or legal guardian of the Child User, and that you have read, understood, and agreed to these Terms on behalf of yourself and the Child User. Adult users (parents/guardians) must be at least 18 years old to access and use the Services on their own behalf.

We reserve the right to verify your identity as a parent/guardian and to restrict or terminate access to the Services if we reasonably believe that you do not meet the eligibility requirements.

2. User Obligations

When using the Services, you and the Child User agree to comply with the following obligations:

  • Comply with all applicable laws, regulations, and these Terms;
  • Do not use the Services for any illegal, harmful, or inappropriate purposes, including but not limited to transmitting or posting content that is violent, pornographic, discriminatory, defamatory, or infringing on the rights of others;
  • Do not attempt to access, modify, or damage the Services, servers, or data related to the Services through unauthorized means (e.g., hacking, cracking);
  • Do not share personal information of yourself or others (including the Child User) with other users without proper authorization, to protect privacy and security;
  • Monitor the Child User's use of the Services, including the time spent using the Services, to ensure that the Child User uses the Services in a healthy and appropriate manner;
  • Do not use the Services to engage in any behavior that may disrupt the normal operation of the Services or affect the user experience of other users.

3. Service Provision and Modification

We strive to provide stable and high-quality Services, but we do not guarantee that the Services will be free from interruptions, errors, or defects. We may modify, suspend, or terminate the Services (or any part thereof) at any time, for any reason (including but not limited to technical upgrades, maintenance, or changes in business needs), without prior notice. We will not be liable for any loss or damage caused by such modifications, suspensions, or terminations, except as required by law.

We may also add new features or functions to the Services from time to time, and such new features or functions will be subject to these Terms unless otherwise specified.

4. Intellectual Property Rights

All intellectual property rights (including but not limited to copyrights, trademarks, patents, trade secrets, and other proprietary rights) in the Services, including but not limited to the games, text, images, logos, and software, are owned by us or our licensors. You may only use the intellectual property rights contained in the Services for the purpose of using the Services in accordance with these Terms, and you may not copy, reproduce, distribute, modify, or use them for any other commercial or non-commercial purposes without our prior written consent. Any unauthorized use of our intellectual property rights may constitute an infringement and may result in legal liability.

5. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, uninterrupted, or secure, or that any defects in the Services will be corrected. You use the Services at your own risk.

We are not responsible for any content generated by users or third parties, and we do not endorse or guarantee the accuracy, completeness, or appropriateness of such content. You are solely responsible for any risks arising from your or the Child User's access to or use of such content.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to damages for loss of profits, data, or goodwill) arising from your or the Child User's use or inability to use the Services, even if we have been advised of the possibility of such damages. This limitation of liability applies regardless of the cause of action (whether in contract, tort, or otherwise).

Our total liability to you for any claims arising from the Services shall not exceed the amount you have paid to us (if any) for the use of the Services in the past 12 months. Nothing in these Terms shall exclude or limit our liability for fraud, willful misconduct, gross negligence, or liability that cannot be excluded by law.

7. Termination

We may terminate or suspend your access to the Services at any time, without prior notice, if you or the Child User violates these Terms, or if we reasonably believe that your use of the Services may cause harm to us, other users, or the public. You may also terminate your use of the Services at any time by discontinuing access to the Services.

Upon termination of these Terms, all licenses granted to you under these Terms will immediately terminate, and you shall cease using the Services. The provisions of these Terms that are intended to survive termination (including but not limited to intellectual property rights, disclaimers of warranties, and limitation of liability) shall remain in effect.

8. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the use of the Services, and supersede all prior or contemporaneous agreements, understandings, or representations (whether oral or written) between you and us.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

We may assign these Terms to any third party at any time, without your prior consent. You may not assign these Terms or any of your rights or obligations under these Terms without our prior written consent.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision.
